Terms of Service

1. Parties to These Terms

1.1 These Terms are entered into between: (a) the developer and operator of Texas Hold'em: Rise of AI, as identified on the Game's current Google Play, official website, or other lawful distribution page ("Operator," "we," "us," or "Party A"); and (b) the natural person who downloads, installs, registers for, signs in to, accesses, or uses the Game or related services ("User," "you," or "Party B").

1.2 While the Game is operated under an individual developer account, Party A is the individual developer identified on the applicable app-store developer page.

1.3 If the development, publication, or operation of the Game is later lawfully transferred to a company or other legal entity, Party A may transfer the rights and obligations relating to operation of the Game under these Terms to that new operator, subject to applicable law.

1.4 Where such a change of operator materially affects users, we will provide notice through the Game, official website, app-store page, privacy policy, or another reasonable channel.

2. Nature of the Game

2.1 Texas Hold'em: Rise of AI is an entertainment and strategy game based on Texas Hold'em gameplay.

2.2 The Game is for entertainment purposes only and does not provide real-money gambling services.

2.3 Chips, coins, points, diamonds, items, rewards, virtual goods, or other in-game virtual assets: are not real currency; have no cash value; are not deposits, securities, financial products, or electronic money; may not be redeemed for cash, cryptocurrency, or other assets of real-world economic value; may not be withdrawn; may not be bought or sold between players for real-world consideration; and may not be used for real-world gambling, betting, or other unlawful activities.

2.4 Obtaining virtual items through gameplay, promotions, purchases, or other lawful means does not create a claim against Party A for an equivalent amount of real-world money.

2.5 Any private gambling, chip trading, account trading, money laundering, fraud, or other unlawful conduct carried out by a user is the user's own conduct. Party A may restrict, suspend, or terminate the relevant account and, where required by law, cooperate with competent authorities.

3. User Eligibility

3.1 You must have legal capacity under the laws applicable to you to use the Game and related services.

3.2 Users below the minimum age required by applicable law for digital services or game use must use the Game only with the permission and supervision of a parent or legal guardian where required.

3.3 If the laws applicable to you prohibit the use of poker, card-game, or similar simulated-game content, you must not use the Game.

3.4 You are responsible for determining whether your use of the Game is lawful in your location.

4. User Accounts

4.1 Certain Game functions may require an account.

4.2 You must provide lawful and valid information where requested and are responsible for safeguarding your account, password, and other login credentials.

4.3 To the extent permitted by law, losses caused by your voluntary disclosure of credentials, account sharing, or security failures on your own device are your responsibility.

4.4 You must not sell, rent, unlawfully transfer, or steal accounts; create accounts in bulk; use automated tools to create accounts maliciously; impersonate another person or organization; or use an account for unlawful activities.

4.5 Where we reasonably suspect fraud, cheating, account theft, abnormal transactions, or another security risk, we may apply temporary restrictions while investigating.

5. Game Rules and Changes

5.1 You agree to comply with Game rules, event rules, competition rules, and other reasonable operational rules published in the Game.

5.2 For game balance, security, operational, or technical reasons, we may adjust gameplay, character attributes, virtual items, rewards, matchmaking, AI mechanisms, events, interfaces, features, or other Game content.

5.3 Game rules and numerical values may change with version updates.

5.4 Where abnormal data, virtual items, or rewards clearly result from a system failure, software error, or exploit, we may reasonably verify, correct, reverse, or adjust them.

6. Virtual Items and In-App Purchases

6.1 The Game may offer in-app purchases.

6.2 Prices, currencies, and payment methods are those displayed by Google Play, Apple App Store, or the applicable payment channel.

6.3 Virtual items obtained through purchases may be used only in accordance with the Game rules.

6.4 Virtual items may not be redeemed for cash, withdrawn, redeemed for cryptocurrency, or traded for real-world consideration.

6.5 Except where mandatory law or the applicable app-store refund policy provides otherwise, refunds for properly delivered digital content or virtual items are handled under the rules of the purchase channel.

6.6 Where payment is processed by Google Play, Apple App Store, or another third-party payment provider, the provider's applicable terms and refund rules may also apply.

7. Prohibited Conduct

You must not: use cheats, hacks, modifiers, scripts, bots, or unauthorized automation; alter the client, server communications, or Game files; exploit bugs or errors for improper benefit; unlawfully crack, decompile, reverse engineer, or attack Game servers; conduct DDoS attacks, malicious requests, unauthorized scraping, or other interference; publish unlawful, fraudulent, threatening, harassing, hateful, pornographic, or seriously inappropriate content; impersonate staff or other users; engage in unlawful account, chip, or virtual-item trading; use Game chips for real-world gambling; use the Game for money laundering, fraud, or other unlawful activity; infringe intellectual property, privacy, or other lawful rights; or otherwise violate applicable law, these Terms, or normal Game order.

8. User-Generated Content and Community Conduct

8.1 If the Game provides chat, nicknames, avatars, profiles, or other user-generated content ("UGC") features, you must use them lawfully and respectfully.

8.2 You must not post or transmit content involving fraud, gambling solicitation, unlawful transactions, threats, harassment, hate, pornography, exploitation of minors, doxxing, malicious spam, or other unlawful or seriously harmful material.

8.3 We may provide reporting, blocking, muting, moderation, and other safety tools. Users should use available reporting tools when encountering suspected violations.

8.4 We may remove or restrict UGC and take account action where reasonably necessary to enforce these Terms, protect users, maintain Game integrity, or comply with law.

9. Enforcement Measures

9.1 If you violate these Terms, we may, depending on the nature and seriousness of the violation, issue warnings; remove content; reset abnormal data; recover virtual items obtained through cheating or exploits; mute the account; restrict functions; suspend services; permanently ban the account; or take other reasonable measures permitted by applicable law.

9.2 For serious suspected fraud, cyberattacks, money laundering, or other potentially unlawful conduct, we may preserve relevant records and cooperate with competent authorities as permitted or required by law.

10. Prohibition on Real-World Trading, Account Trading, and Related Penalties

10.1 To protect fairness, security, and compliant operation, you must not buy, sell, rent, lend, gift, exchange, or transfer for consideration any Game account, chips, coins, points, items, or other virtual assets. You must not use fiat currency, cryptocurrency, gift cards, goods, services, or other property of real-world economic value as consideration. You must not provide top-up services, purchasing or selling services, guarantees, brokerage, solicitation, advertising, contact information, groups, websites, QR codes, or other channels for such transactions.

10.2 These prohibitions apply both inside and outside the Game. Even where negotiations, solicitation, payment, or delivery occur through WeChat, WhatsApp, Telegram, Facebook, Discord, websites, forums, or other external channels, we may treat the conduct as a violation where there is reasonable evidence connecting it to Game accounts, chips, coins, points, items, or other virtual assets.

10.3 Based on Game logs, account relationships, chat records, user reports, abnormal transfer records, transaction indicators, or other reasonable evidence, where we determine or reasonably suspect prohibited trading, we may, according to severity, issue a warning; remove violating content; mute the account; restrict chat, gifting, transfer, matchmaking, or other functions; reverse abnormal transactions or gains; deduct, recover, or reset to zero chips, coins, points, items, or other virtual values related to the violation; temporarily freeze the account; permanently ban the account; or take other reasonable measures permitted by law.

10.4 Game chips, coins, points, items, and other virtual goods are digital Game content or limited rights of use only. They are not fiat currency, electronic money, deposits, securities, or other financial assets, have no cash value, and may not be withdrawn or exchanged for fiat currency, cryptocurrency, or other property of real-world economic value.

10.5 Accounts suspected of gambling, money laundering, fraud, account theft, unlawful funds transfer, or other unlawful conduct may be immediately restricted or protected as reasonably necessary. We may preserve relevant records and comply with lawful requests from competent authorities.

10.6 Enforcement will be based on reasonable grounds and applicable law. If an action is later found to have resulted from system error, insufficient evidence, or a successful user appeal, we will correct the action within a reasonably practicable scope. You may appeal through the customer-support or appeal channel we publish.

11. Updates, Maintenance, and Service Changes

11.1 We may update, maintain, upgrade, or modify the Game from time to time.

11.2 The Game may be temporarily unavailable because of maintenance, security updates, force majeure, third-party failures, network failures, or similar events.

11.3 To the extent permitted by law, we do not guarantee uninterrupted or error-free service, but we will take reasonable measures to maintain stability and security.

12. Intellectual Property

12.1 The Game and related content, including source and object code, specific expression of game mechanics, interface design, characters, artwork, animation, music, sound, text, databases, trademarks, logos, and other protected materials, belong to Party A or the relevant rights holders.

12.2 Without authorization, you may not reproduce, sell, rent, modify, republish, or commercially exploit protected Game content except as permitted by applicable law.

13. Third-Party Services

13.1 The Game may use third-party services such as app stores, cloud hosting, login services, payment services, analytics, crash reporting, and security services.

13.2 Third-party services may have their own terms and privacy policies, which may apply when you use those services.

14. Limitation of Liability

14.1 To the maximum extent permitted by applicable law, Party A is not liable beyond the scope required by law for service interruption or loss caused by force majeure, telecommunications failures, cloud or third-party platform failures, user-device failures, voluntary disclosure of credentials, unauthorized third-party attacks, app-store or payment-platform failures, legal or governmental measures, or other events beyond reasonable control.

14.2 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Termination and Account Deletion

15.1 You may stop using the Game at any time.

15.2 Where the Game provides an account-deletion function, you may request account deletion through the method provided in the Game or through the external account-deletion channel we publish.

15.3 After account deletion, Game progress, virtual items, chips, and other account data may be permanently lost and may not be recoverable, subject to data that must or may lawfully be retained.

15.4 If we permanently discontinue the Game, we will, where reasonably practicable, provide advance notice through the Game, official website, app-store page, or another appropriate channel, except in urgent security, legal, or force-majeure circumstances.

16. Privacy

16.1 We value your privacy. The collection, use, storage, sharing, deletion, and protection of personal data, and your related rights, are described in the Texas Hold'em: Rise of AI Privacy Policy.

16.2 The Privacy Policy forms an important part of these Terms.

17. Amendments to These Terms

17.1 We may amend these Terms due to changes in law, platform policies, Game functions, security requirements, or the operating entity.

17.2 Where an amendment materially affects user rights or obligations, we will provide reasonable notice through the Game, official website, app-store page, or another appropriate channel.

17.3 Updated Terms apply from the effective date stated in the updated version.

18. Applicable Law and Dispute Resolution

18.1 These Terms, including their formation, interpretation, validity, and performance, shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

18.2 Any dispute arising out of or in connection with these Terms or the Game services shall first be addressed through good-faith consultation. If the dispute cannot be resolved, it shall be submitted to the courts of the Hong Kong Special Administrative Region having competent jurisdiction. Nothing in this Section limits any non-waivable rights or remedies available to a user under mandatory consumer-protection, personal-data-protection, or other laws that are applicable to that user.
